overpayment of maternity pay.........help

I have recently discovered that i have been paid enhanced maternity pay from my employer( which means i have to go back to work for 3 months or pay back the money). When i first went on mat leave i told them that i didnt want the extra money,as i wasnt sure if i was going back to work. They now want the money back in one go (almost £600) from my next pay on friday......i only get about £450 smp which means im not going to get paid, and the same the following month... HELP does anyone know if they can do that? I wont have money for 2 monthes and have an 8yr old boy and an 11 wk old boy, and xmas is just round the corner......... xxxxxx linda

Due to it being there error they can not legally take the full amount back from one pay day due to financial hardship, I suggest you make them an offer of say £50 per pay day, pay back and see what they say. Hope this helps

Hi, im on mat leave at mo, employers made a mistake re: my pay, basically, although i notified them I was taking mat leave, when ect and provided documents etc they didnt put it on their system so whilst on mat leave (work didnt send on my pay slips to me) they were paying me full pay for 4 months (I owe over £1000) I contacted them pointed out it was THEIR mistake and stated I could not pay the lump sum in one go!! to be fair to them they accepted this, and I can pay it back when I return to work (as at mo on SMP) however, not sure if im returning so they've really p****d me off!!! It depends on what organisation you work for but its unreasonable for them to expect you pay it all in one go, for crying out loud you have a new addition to your family and already have a reduced wage!! tell them this (im sure you have) if your in a union then ask for their help. Try and appeal to their better nature, put it in writing putting forward your case. Good Luck, Vicky

Bloody H**l!! I agree that as they made the error, they shouldn't be able to claim it back in 1 go, but I'm not sure if they have any legal obligation to agree to an offer or not! I know people who have been over paid in a range of different situations (i.e. not always maternity pay) where I work and in each case it has been the company's fauly but they have refused any kind offers of repayment!! I would speak to the CAB to find out exactly what your rights are!! Good luck honey and don't give up with out a fight!!!! Leigh and bump xxx

Hi, this is a legal issue you need to take proper advice. Try your local C.A.B office. If it's there error i dont think you should have to pay it back but you need to speak to an expert. If you try to talk to your personnel dept at work of course they're gonna tell you you need to pay it back they'll probably in a lot of troble of it if you don't pay it and don't go back.

i wud speak to ur personel dept as by the time the cab hav done anything u will hav paid it back anyway, were ment to get a fair deal wiv work and having babies but it doesnt happen, im 27 wks pregnant and hav jus found myself single as my ex partner worked and i stayed at home cos our youngest is 3. wen i tried to find a job no1 wud hire me as im in my 3rd trimester,and the job centre jus kept tellin me i wud get 1 eventually. im ment to b on a stress free pregnancy cos in feb this year i had a baby boy who was 16 weeks prem, so on my check up last week my doctor has told me i cant work anyway cos i cud go into prem labour again! so after a million forms im now reicievin incapacity benefit till ive had my baby and am ready for work, i dint realise wot help was out there is u suddenly become a single parent.
